Your privacy is important to TAFHighlight Pty Ltd (referred to as TAFHighlight, "we," "us," or "our"). This Privacy Policy explains how TAFHighlight collects, uses, stores, and discloses your information when you use our mobile application and website (TAFHighlight.ai – the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Privacy Policy.

1. Our Commitment to Privacy

We are committed to protecting the personal information we collect and handling it in compliance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) and other applicable global privacy regulations, including the European Union's General Data Protection Regulation (GDPR), where relevant.

  1. Data Minimization: We adhere to the principle of data minimization. We only collect and retain personal information that is strictly necessary for the purposes outlined in this policy. We do not hold unnecessary personal information.

 

2. Information We Collect

We collect two main types of information: Personal Information (which directly identifies you) and Non-Personal Information (which cannot).

 

2.1 Personal Information (Solicited)

  • Email Address (Optional): We collect your email address if you choose to provide it during account registration or for specific service features. Providing your email address is not mandatory to use the core TAF/NOTAM filtering Service.

  • Contact/Inquiry Details: We collect your name, email address, and the content of any message when you contact us for customer support or inquiries.

  • Billing/Transaction Data: We do not directly collect or store payment details (such as credit card numbers). All payment transactions are processed through the respective platforms (Apple App Store or Google Play Store), which handle your payment information subject to their own privacy policies. We receive limited transaction data (e.g., subscription type and start date) to manage your active service.

2.2 Non-Personal and Usage Information (Collected Automatically)

We automatically collect information about how you access and use the Service:

  • Usage Data: Information about how you interact with the app, such as features accessed, filters used, flight routes searched, time spent on the app, and service requests. This data is collected for analysis and product improvement.

  • Device Information: Technical information about the device you use, such as your IP address, device model, operating system, and unique device identifiers.

  • Analytics Data: Data collected for the Referral Program, including total referrals and conversions, as outlined in Section 5A of our Terms and Conditions. This is primarily non-identifiable usage data.

 

3. How We Use Your Information

We use the information we collect for the following primary and secondary purposes:

Purpose Category - Details

Service Provision - To operate, maintain, secure and deliver the core TAF/NOTAM filtering features.

Account Management - To manage your subscription, process payments, and provide you with account recovery options (if email is provided).

Record Keeping - To maintain internal records of user accounts, service activity, and transaction history.

Marketing & Communication - If you have provided consent (by providing your email address), we will use it to send you marketing communications, updates about the Service, and special offers.

Service Improvement - To understand usage trends, diagnose technical problems, and develop new features.

 

4. Data Sharing and Cross-Border Disclosure (APP 8)

 

We will only disclose or share your personal information in accordance with this Privacy Policy and the APPs.

  1. Service Providers: We may share non-identifying data and, where necessary, limited personal information with third-party service providers (e.g., cloud hosting, analytics, and infrastructure providers) to perform services on our behalf. These third parties are legally obligated to protect your data and are prohibited from using it for any purpose other than providing services to us.

  2. International Disclosure: Since TAFHighlight uses global cloud infrastructure and service providers, your information is likely to be transferred to and stored outside of Australia (e.g., in the United States or other locations). By using the Service, you acknowledge and agree that your personal information may be transferred across international borders.

  3. Legal Compliance: We may disclose your information if required to do so by Australian law or a binding legal order, subpoena, or valid request by a public authority anywhere in the world.

  4. Legal Obligation to Retain Financial Data: Notwithstanding a user's request for account deletion, TAFHighlight is legally required to retain records of all financial transactions for a period of up to seven (7) years to comply with Australian tax, accounting, and auditing laws. This retained data is limited to the transaction record and the associated email address, and it is permanently deleted once the mandated retention period has expired. This minimal retention is necessary for the performance of a legal obligation and is therefore exempt from immediate erasure.

We do not sell, rent, or trade your personal information to third parties for their independent marketing purposes.

 

5. Data Security (APP 11) and Retention

  1. Security: We employ industry-standard technical and organizational security measures (such as encryption and access controls) to protect your personal information from misuse, interference, loss, unauthorized access, or unauthorized disclosure. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

  2. Retention: We retain personal information only for as long as is necessary to fulfill the purposes outlined in this policy or as required to meet our legal or accounting obligations (as detailed in Section 4.d). Once information is no longer needed, we will take reasonable steps to destroy or de-identify it.

 

6. Your Privacy Rights and Choices (Access and Correction)

Under the APPs, and depending on your location, you have certain rights regarding your personal information:

  1. Access and Correction (APP 12 & 13): You have the right to request access to the personal information we hold about you and to request that we correct any inaccurate, incomplete, or outdated information.

  2. Anonymity (APP 2): Since providing an email address is optional, we offer a degree of anonymity. However, due to the account-based nature of the service, complete anonymity may not be practicable.

  3. Opt-Out (Direct Marketing - APP 7): If you receive marketing emails from us, you may opt out at any time by following the 'unsubscribe' link within the email.

 

7. Privacy Complaints

If you have a complaint about how we have handled your personal information or a suspected breach of the APPs, please contact us immediately using the details below. We will acknowledge your complaint and respond to you within a reasonable period. If you are dissatisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC).

 

8. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on our website and updating the "Last Updated" date at the top of this document.
